1. Overview
Pixel Pioneers ("Platform", "we", "us", "our") is an online photography community operated by Pixel Pioneers, based in Alappuzha, Kerala, India. By accessing or using pixelpioneers.in, you ("User", "Member") agree to be bound by these Terms & Conditions. If you do not agree, please do not use this Platform. These Terms govern your access to and use of all features including gallery submissions, membership plans, challenges, exhibitions, community discussions, and the Hire a Photographer service.
2. Eligibility
You must be at least 18 years of age to register for a paid membership or transact on this Platform. Users between the ages of 13–17 may browse the Platform with parental consent but may not purchase subscriptions. By creating an account, you represent that all information provided is accurate and current. Pixel Pioneers reserves the right to suspend or terminate accounts where eligibility requirements are not met.
3. Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at pixepioneersin@gmail.com if you suspect unauthorised access. Pixel Pioneers will not be liable for any loss arising from your failure to protect your credentials. You may not create accounts for others, operate multiple accounts to circumvent restrictions, or transfer your account to any other person.
4. Membership Plans & Payments
Pixel Pioneers offers Free, Pro, and Elite membership tiers. Paid memberships are billed on a monthly or annual basis in Indian Rupees (INR). All transactions are processed securely by Razorpay, a PCI DSS–compliant payment gateway authorised by the Reserve Bank of India. By initiating a payment, you agree to Razorpay's Terms of Service at razorpay.com. Pixel Pioneers does not store your card details. Membership fees are displayed inclusive of applicable GST. Plan features are subject to change with 30 days' prior notice to existing subscribers.
5. Refunds & Cancellations
Refund and cancellation terms are detailed in our Refund & Cancellation Policy available at pixelpioneers.in/refund-policy/. In summary: you may cancel a paid subscription at any time from your Dashboard. Cancellations take effect at the end of the current billing cycle; no prorated refunds are issued for unused periods unless a technical billing error is established. Refund requests must be submitted within 7 days of the payment date. Pixel Pioneers reserves the right to refuse refunds where usage has occurred beyond a nominal exploratory period.
6. User-Generated Content
By submitting photographs, comments, discussion posts, or any other content ("Content") to Pixel Pioneers, you retain full ownership of your intellectual property but grant Pixel Pioneers a non-exclusive, royalty-free, worldwide licence to display, reproduce, and promote your Content solely for the purposes of operating and marketing the Platform. You represent and warrant that: (a) you own or have the right to submit the Content; (b) the Content does not infringe any third-party intellectual property, privacy, or publicity rights; (c) the Content does not contain nudity, graphic violence, hate speech, or any material illegal under Indian law. Pixel Pioneers reserves the right to remove any Content at its sole discretion without prior notice.
7. Prohibited Conduct
You agree not to: upload content that is obscene, defamatory, discriminatory, or violates Indian law; attempt to scrape, reverse-engineer, or systematically extract data from the Platform; use automated bots or scripts to vote, follow, or otherwise engage; harass, impersonate, or threaten other members; circumvent any access controls or attempt to gain unauthorised access to accounts or systems; use the Platform for commercial advertising without prior written consent; or engage in any activity that disrupts or degrades Platform performance for other users.
8. Intellectual Property
The Pixel Pioneers name, logo, design system, codebase, and all Platform-generated content (excluding user-submitted photographs) are the intellectual property of Pixel Pioneers and may not be reproduced, distributed, or used in derivative works without express written permission. Photographers retain copyright over their individual images. Pixel Pioneers does not claim ownership over submitted photographs.
9. Photo of the Week & Challenges
Participation in Photo of the Week and Challenge features is open to members who meet the criteria stated for each event. Winners receive recognition and, where applicable, listed rewards. Pixel Pioneers' decisions are final. Entry into any curated programme implies consent for the Platform to use the photograph in promotional material for that programme, crediting the photographer.
10. Hire a Photographer
The Hire section connects prospective clients with photographers. Pixel Pioneers acts solely as an introduction platform and is not a party to any agreement between clients and photographers. Pixel Pioneers does not guarantee the quality of services, enforce contractual terms between parties, or handle payments for photography services. Any disputes arising from hire engagements are between the client and photographer exclusively.
11. Privacy
Your privacy is important to us. Please review our Privacy Policy at pixelpioneers.in/privacy-policy/ to understand how we collect, use, and protect your data. Our Privacy Policy is incorporated into these Terms by reference.
12. Disclaimers & Limitation of Liability
The Platform is provided "as is" and "as available". Pixel Pioneers does not warrant uninterrupted or error-free access. To the maximum extent permitted by applicable Indian law, Pixel Pioneers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, including loss of data, revenue, or opportunities. Our aggregate liability for any claim shall not exceed the subscription fees you paid in the 3 months preceding the claim.
13. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Alappuzha, Kerala. Before initiating formal proceedings, both parties agree to attempt good-faith resolution through direct communication for a period of 30 days.
14. Modifications to Terms
Pixel Pioneers reserves the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
